We Didn’t See Adeleke In Exam Hall, Witnesses Tell Court

Two witnesses in the ongoing trial of Sen. Ademola Adeleke on a seven-count amended charge bordering on examination malpractice on Wednesday told the Federal High Court Abuja that they did not see the senator in the examination hall.

The witnesses, Mr Emmanuel Adesola and Enoch Adigun, both teachers, while being led in evidence by the prosecutor Mr Simon Lough, told the court that they invigilated examinations at Ojo -Aro Community Grammar School in Osun State in 2017.

Adesola told the court that when he got to school, he asked for the school album but was told it was not ready.

According to him, “I could not identify any student without the school album since it was my first time there so the principal and the register helped me to identify them as I used the list I had to call the students into the hall.

“I didn’t see any of the defendants in the examination hall; Sen. Adeleke was not in the examination hall, he is a public figure so I would have recognised him,” the witness told the court.

The witness who further told the court that he had been supervising National Examination Council (NECO) examination for the past five years also told the court that there were four elderly students in the hall.

While being cross examined by Mr Alex Iziyon, (SAN), the witness said that he did not make a formal report on the absence of a school album to his superiors even though he ought to have done so.

He also told the court that on the day he invigilated, he did not witness any form of examination malpractice in the hall.

On his part, Adigun told the court that he saw the second defendant, Sikiru Adeleke in the examination hall while he was invigilating.

According to Adigun, I was surprised to see him because he was the most matured student in the hall but when I checked and saw that he had an identity card duly stamped by the school, I had to allow him write the examination.

Adigun said that he didn’t see Adeleke in the examination hall or any of the other defendants besides Sikiru.

The trial judge, Justice Inyang Ekwo adjourned the matter until June 10 and 11 for continuation of hearing.

Adeleke was first arraigned by the Federal Government in Sept. 2018 on a four-count charge bordering on examination malpractice, along with his brother, Sikiru Adeleke and three others.

The senator pleaded not guilty to the charges and was granted bail on self-recognizance by the court.

The others were Alhaji Aregbesola Mufutau (Principal, Ojo-Aro Community Grammar School, Ojo-Aro Osun), Gbadamosi Ojo (School Registrar) and Dare Olutope (a teacher).

The police accused them of fraudulently registering Adeleke and his brother Sikiru as students of Ojo-Aro Community Grammar School in Ojo-Aro, Osun State, for the National Examination Council’s June/July 2017 Senior School Certificate Examination in Feb. 2017.

They were re-arraigned in Dec. 2018 on a seven-count amended charge bordering on examination malpractice.

Four Reasons Why Judgment Nullifying My Candidacy Won’t Stand — Adeleke

$

Senator Ademola Adeleke has given four reasons why he believes the Tuesday’s judgment of the High Court of the Federal Capital Territory, Bwari, Abuja, nullifying his candidature for the September 2018 governorship election in Osun State, would not stand.

Justice Othman Musa of the FCT High Court in Bwari, Abuja, had, on Tuesday, nullified Adeleke’s nomination by the Peoples Democratic Party for the last year’s poll.

The judge held that Adeleke was not qualified to run for the office of a governor, not being, allegedly, educated up to secondary school level as required of him under Section 177 of the Nigerian Constitution.

But, rejecting the judgment in an early Wednesday’s statement, Adeleke vowed to appeal against it, describing it as “flawed and a travesty of justice.”

“While we are set to appeal the judgment, we also find it compelling to put the records straight by listing out the fatal flaws in the ruling and why it cannot stand before any court,” Adeleke said in the statement.

The statement titled, ‘Flawed Bwari judgment against Senator Adeleke cannot stand!’, issued on his behalf in the name of his campaign organisation, was signed by a lawyer, Niyi Owolade.

Adeleke said the message which he “received with bewilderment,” “subverted justice by ignoring four critical evidence to rule against validated facts and submissions.”

Faulting the judgment, Adeleke said, firstly, there had been “two rulings delivered in September 2018” which “held that Senator Adeleke satisfied all requirements of the law to contest for office.”

He stated that the Tuesday judgment breached the “precept” that “once a court of coordinate jurisdiction has ruled on a matter, court of similar jurisdiction cannot entertain it.”

The statement added that the judge “erred in law by failing to take note of the expiration of 180 days for ruling on pre-election matters.”

It added, “Even when a December 2018 judgment with respect to the issue was presented, the judge chose to ignore it.

“We note that the judge violated the law by adjudicating over a matter whose filing and hearing period had expired.”

Adeleke’s third reason for faulting the judgment was that the judgment ignored the evidence produced by the West Africa Examination Council which listed “all students who sat for the May/June examination in 1981 alongside the senator, in addition to the certified true copies of his school certificate result.”

The statement said, “From the evidence produced by the Council, it is crystal clear that Senator Ademola Adeleke was, indeed, educated beyond the minimum requirement of ‘up to secondary school level’ as stipulated by law and therefore qualified to run for the office of governor in accordance with Section 177 (D) of 1999 CFRN (as amended). Not withstanding, the judge still went ahead to rule otherwise.

“The only statutory body empowered by law to determine authenticity of a secondary school results is the West African Examination Council and they confirmed the authenticity of Senator Adeleke’s result by producing a CTC of the same result. What evidence did the judge therefore base his ruling on?”

Lastly, Adeleke said, the judge was wrong to conclude that he forged the senior secondary school statement of result which he submitted to the Independent National Electoral Commission.

Adeleke explained that having been shocked by the evidence produced by WAEC showing that he sat for the May/June 1981 examinations, the plaintiffs, again, went on to have the principal of the school to appear in court to confirm the authenticity of the statement of results.

He said, “The principal appeared and confirmed that the statement was genuinely issued by the school and that any error noticed on the statement was that of the school, not that of Senator Adeleke. The school did not, at any point, disown the statement of results.”

He said the school “owned up to the error, which was not about forgery.”

He said, “From the foregoing, we affirm that the judgment of the Bwari court is a travesty of justice, a purchased ruling designed to negatively affect the outcome of Osun governorship judicial process.

“We declare unequivocally that the ruling, being so glaringly against tested facts and the law, cannot stand.

“It is also clear that the ruling cannot, in any way, stop the reality that Senator Ademola Adeleke fulfilled constitutional requirements to be Governor of Osun State.

“We appeal to our numerous supporters and good people of Osun State to remain calm.

“This is another failed bid in the efforts of detractors and enemies of democracy.

Senator Ademola Adeleke is not only qualified but by the grace of God will soon be sworn in as the legitimate Governor of Osun State.”

After 11 years, the NPA Simulation Facility comes alive in Apapa, Lagos.

In a bid to conserve foreign exchange, the Nigerian Ports Authority (NPA) has partnered its joint venture partners to build a simulation centre for the training of pilots locally.

Speaking at the inauguration of the simulation centre in Lagos yesterday, the Managing Director of the NPA, Hadiza Bala-Usman, said training of pilots locally would save the federal government over $1 million (N366 million) annually spent in training pilots in the United Kingdom, other Europe countries and the United States of America.

The Simulator will be used to train pilots and for research and other purposes. The Simulator has software that realistically simulates the behavior of a vessel and its systems in a simulated maritime environment and has an interface that allows the person using it to control the ship & interact with its simulated surroundings.

The idea which was conceived 11 years ago has the Honourable Minister of Transportation Rt. Hon. Rotimi Chibuike Amaechi commissioned the NPA Simulation Facility.

According to NPA, the Centre has in the last 8 months trained 98 Nigerian pilots that hitherto would have been sent abroad, saving the country a significant amount of foreign exchange. With this commission, the Authority is expected to save an average of One Million US Dollars ($1,000,000) annually from the training pilots overseas yearly.

These are images of the centre and also from the commissioning in Apapa, Lagos.

Chelsea vs Brighton
Brighton head to Chelsea on Wednesday night in the Premier League.

Chelsea come into the game on the back of a jammy 2-1 win away at Cardiff last Sunday.

Despite a poor performance in Wales, goals from Cesar Azpilicueta and Ruben Loftus-Cheek earned the Blues a win they didn’t deserve.

The win boosted Chelsea’s hopes of ending the season in the top four.

Brighton lost 1-0 at home last weekend to Southampton.

The Seagulls remain in the relegation shake-up with 33 points from 30 games.

Eden Hazard in, Gonzalo Higuain dropped
On Wednesday the Times have gone about predicting the respective line-ups for tonight’s match at Stamford Bridge.

Last weekend Maurizio Sarri drew scorn for his starting XI at Cardiff.

Neither Eden Hazard nor N’Golo Kante started that match for the Blues.

However against Brighton, the Times predict both Hazard and Kante will be back in the team.

Perhaps the most interesting prediction in the Times is that Gonzalo Higuain will be dropped against Brighton.

Higuain has struggled to impress since joining the Blues on loan from Juventus.

Olivier Giroud is expected to be given the nod in attack.

Finally, the Times believe Callum Hudson-Odoi will finally be handed his first Premier League start tonight. The teenager was left on the bench against Cardiff.

In recent days, a lot of Nigerians took to social media to join voices in the ‘End SARS‘ media campaign. The campaign got more serious after an innocent Nigerian – Mr. Kolade Johnson – was mistakenly shot dead by a SARS official on Sunday where he went to watch a football match.

Unlike before, the President of the country responded to the campaign using his official Twitter handle. He is of the opinion that the government will not tolerate brutalization of Nigerian citizens or the violation of their rights in any way.

In his tweets, he wrote;

Let me make it clear that the Government will not tolerate in any way the brutalization of Nigerians or the violation of their rights. Any law enforcement officer or government functionary caught in this act will be visited with the full weight of the law.

The recent unfortunate action of SARS operatives from the Lagos State Police Command, which led to the avoidable death of Mr. Kolade Johnson, is deeply regretted. Once again, our condolences to the family of the deceased. I’m aware the Police authorities have visited them.

I acknowledge the genuine outrage from citizens and Civil Society groups regarding the activities of SARS. As you’re aware, the Suspects in the Kolade Johnson killing are in custody. When the orderly room trial is concluded, indicted officers will be prosecuted in court.

While important steps have been taken by the Police leadership to restructure and reform SARS, in line with presidential directives, more needs to be done. I assure this will be done. We will continue to work to ensure that we have a Police Force that adheres to the rule of law.
